Taskify Terms of Service
Taskify Oy (hereinafter referred to as “Taskify”), registered in Finland with the business ID 3304592-6, owns and manages the Taskify.fi website, the Taskify® mobile application, and the Taskify® web application (hereinafter collectively referred to as “Platform”).
Please take a moment to carefully read these Terms of Service (hereinafter referred to as “Agreement) which includes, and incorporates by this reference, the Privacy Policy and any other referenced policies and guidelines.
This Agreement governs use of the Platform, including your request, offer and purchase of services on the Platform. By using the Platform you confirm acceptance of the terms and conditions of this Agreement. If you do not agree to this Agreement you must immediately discontinue your use of the Platform.
Nothing in this Agreement shall be construed to create an employment relationship between Taskify and any Platform user. Each Platform user is personally responsible for their own legal and other transactional matters including taxation.
Taskify reserves the right to modify at any time the terms and conditions of this Agreement. Modifications are effective when the modified Agreement (including the Privacy Policy and any other referenced policies and guidelines) is posted on the Platform. Your use of the Platform following the posting of any such modifications shall constitute your acceptance of those modifications.
You are advised to review this Agreement (including the Privacy Policy and any other referenced policies and guidelines) whenever you visit the Platform to understand the currently applicable terms and conditions governing use of the Platform.
This Agreement (including the Privacy Policy and any other referenced policies and guidelines) are available in Finnish and English with the operative version being the English.
This Agreement shall be governed by the laws of Finland. Any disputes, claims or controversies arising from this Agreement shall be resolved in good faith negotiation. Should the matter remain unresolved for more than thirty (30) days from the start of negotiation, it shall be subject to final and binding resolution in arbitration in accordance with the Arbitration Rules of the Arbitration Institute of the Finland Chamber of Commerce (hereinafter referred to as ¨FAI¨) pursuant to the regulations in force. The number of arbitrators to be appointed by the FAI shall be one (1), the place of arbitration shall be Helsinki, Finland and the language of arbitration shall be English.
Platform User Terms
- The Platform offers digital services that include customer relationship management tools for service requests, offers and purchase, payment handling as well as streaming services.
- User account terms and conditions
- Creating a user account is required to be able to use the Platform. There are separate user accounts for the Service Provider and Customer.
- When you create a user account on the Platform, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the terms and conditions hereof, which may result in immediate suspension or termination of your user account.
- You may not use as a username the name of another person or entity that is not lawfully available for use, or a name or trademark that is subject to any rights of another person or entity other than yourself without appropriate authorisation, or a name that is otherwise offensive, vulgar or obscene.
- You are responsible for safeguarding and keeping confidential the password that you use for your user account and for any activities or actions under your password, whether your password is for the Platform or a third party service.
- You must notify Taskify immediately upon becoming aware of any breach of security or unauthorised use of your user account.
- Taskify may at its own discretion suspend or terminate your user account immediately, without prior notice or liability, for any reason whatsoever, including without limitation for breach of any of the terms and conditions hereof. Upon suspension or termination, your right to use the Platform shall cease immediately.
- If you wish to terminate your user account, you may simply discontinue using the Platform or give notice by e-mail to info@taskify.fi
- A “Service Provider” refers to any person with valid business ID (such as a private trader or a limited liability company) registered in the Tax Authority Prepayment Register and (if applicable) also in the VAT register, who is using the Platform including for managing their businesses or offering services for purchase to a Customer on separately agreed terms. The Service Provider agrees that Taskify may contact relevant authorities to verify this information.
- A “Customer” refers to any person using the Platform, including for requesting and purchasing offered services from a Service Provider on separately agreed terms.
- The Platform is the interface/platform that only acts as an intermediary between Service Providers and Customers. The Service Provider and Customer enter into a separate purchase agreement upon confirmation of a service offer by the Customer. All service prices are inclusive of VAT.
- Taskify is only responsible for the Platform and the functionality of the Platform and is not a contracting party to any transaction between a Service Provider and a Customer.
- The Platform is currently in BETA mode which implies that a Service Provider or Customer may experience unintended bugs and service disruptions. By using the Platform during this BETA period, a Service Provider or Customer also acknowledges these possibilities. Taskify shall not be held responsible or accountable in any way for any legal, financial or any other damage or harm caused by the bugs and service disruptions on the BETA mode Platform to any Service Provider or Customer.
- Taskify uses an external third party integration for handling financial transactions including making and receiving payments on the Platform, who for this purpose may have access to your personal data only to perform these tasks and is obligated not to disclose or use it for any other purpose. Otherwise Taskify has no control over, and assumes no responsibility for the content, privacy policies or practices of any third party sites or services.
- In order to use the Platform you must be at least 18 years old. If you register and/or use the Platform as a business entity, you represent and warrant that you are fully authorised and have the capacity to represent and act on behalf of such business entity.
Service Provider Terms
- Customer service requests with relevant information will be visible on the Platform map. Service Providers may respond with an offer which matches the relevant information or which amends the relevant information.
- A purchase agreement between a Service Provider and Customer is formed with the relevant information as separately agreed terms upon confirmation of a service offer by the Customer. The Platform has a chat function which opens after payment by the Customer of the agreed service price through which the Service Provider and Customer may request or provide additional information after the confirmation, such agreed additional information also forming terms of the purchase agreement. The original terms of the purchase agreement agreed when the Customer confirms a Service Provider's offer may not be changed using the chat function, such as the agreed service price or starting time of service.
- Taskify is entitled to charge the Service Provider a service fee of €1,9 + 10% applied to any service price inclusive of VAT paid by the Customer. No service fee is charged in case of a refund as a result of a Customer who is a consumer cancelling a confirmed service offer.
- A Service Provider may cancel a confirmed service offer with full refund of the service price to the Customer before the agreed starting time of service subject to a cancellation fee of €1,9 + 10% applied to the agreed service price inclusive of VAT.
- Upon completion of the service the Service Provider shall confirm the service as completed on the Platform. The service is deemed completed even without such confirmation after twenty-four (24) hours from the agreed starting time of service.
- A Service Provider may rate a Customer for their compliance with the agreed purchase agreement terms using a star rating on the Platform.
- The Service Provider authorises Taskify to issue service price payment receipts to the Customer on behalf of the Service Provider in respect of any purchase of offered services by the Customer in accordance with the Value Added Tax Act (1501/1993) (as amended from time to time).
- Payment by Taskify to the Service Provider will be on the fifteenth (15th) day of each month for service price payments inclusive of VAT made by the Customer before this date. Payment will be to the bank account designated by the Service Provider when creating the user account. Taskify will issue an itemised payment slip for every payment.
- The Service Provider is required to have liability insurance in their name in order to use the Platform. The name of the insurance company and the insurance policy number must be provided when creating a user account. The Service Provider agrees that Taskify may contact the insurance company to verify this information.
- Content published on the Platform
- A Service Provider is required to provide content on the Platform, at the minimum to include the name of the Service Provider, description of services offered, and whether cleaning materials are provided.
- Service Provider content including titles, service descriptions and terms, as well as footages including pictures and videos must not contain illegal, inappropriate, disturbing, hateful or similarly explicit contents.
- Platform users may notify such contrary content to Taskify by email info@taskify.fi
- Taskify may remove such contrary content as well as suspend immediately and without prior notice the Service Provider's user account at the discretion of Taskify. You may request a review of your user account suspension by e-mail to info@taskify.fi
- The Service Provider shall indemnify and not hold Taskify responsible or accountable in any way for any legal, financial or any other damage or harm caused by any Service Provider content.
- The Service Provider shall indemnify and not hold Taskify responsible or accountable in any way for any legal, financial or any other damage or harm caused by any acts or errors of the Service Provider, including their offer of services for purchase or their performance of services.
Customer Terms
- A Customer may place a service request on the Platform and enter the required relevant information which includes category and description of service, starting time, service price and whether suitable cleaning materials are available. Service Providers may respond with an offer which matches the relevant information or which amends the relevant information. The Customer may confirm or ignore a Service Provider offer.
- A service request will automatically expire one (1) hour before the starting time of service indicated in the relevant information if the Customer has not confirmed any Service Provider's offer. The Customer may also cancel a service request before it expires without confirming any Service Provider's offer.
- A Customer may make a maximum of five (5) service requests simultaneously with different relevant information. The Customer should take care to accept only one (1) Service Provider's offer made in response to a service request for the same date and category of service to avoid any consequent legal liability.
- A purchase agreement between the Customer and Service Provider is formed with the relevant information as separately agreed terms upon confirmation by the Customer of a Service Provider's offer, at which time the Customer shall make payment on the Platform. The Platform has a chat function which opens after payment by the Customer of the agreed service price through which the Service Provider and Customer may request or provide additional information after the confirmation, such agreed additional information also forming terms of the purchase agreement. The original terms of the purchase agreement agreed when the Customer confirms a Service Provider's offer may not be changed using the chat function, such as the agreed service price or the starting time of service.
- Payment shall be made on the Platform at the time a purchase agreement is confirmed by using direct payment, debit/credit card or by any other payment methods made available on the Platform. The available methods of payment will be displayed upon confirmation of the purchase agreement and generally accepted methods of payment are displayed on the Platform. Taskify does not guarantee that all methods of payment are available at all times, and some payment methods may be temporarily unavailable or restricted from time to time. Taskify further reserves the right to offer additional and/or remove existing payment methods at any time at its sole discretion.
- The Service Providers are responsible for the performance of any confirmed service offer as per the purchase agreement terms.
- The Customer or their authorised representative must be present at the agreed location and starting time of service to allow access to the Service Provider, or otherwise to make access possible in some other way as agreed in the purchase agreement. The purchase agreement is deemed cancelled by the Customer without right to any refund if access by the Service Provider is not possible within 15 minutes from the agreed starting time of service.
- Upon completion of the service the Customer is recommended to confirm the service as completed on the Platform within twenty-four (24) hours, following which the service is deemed completed even without such confirmation from the Customer.
- In the event of dissatisfaction with a Service Provider's performance the Customer may notify the Service Provider of the dissatisfaction and the reasons whereof by using the chat function on the Platform within twenty-four (24) hours from the time the Service Provider has confirmed the service as completed. The Customer and Service Provider may agree on any possible rectification including a refund amount which is payable by the Service Provider directly to the Customer. In the event the Customer and Service Provider are not able to agree then the customer may have recourse to other remedies under the laws of Finland. A customer who is a consumer may contact the Consumer Advisory Services of the Finnish Competition and Consumer Authority or refer the dispute to the Consumer Disputes Board. The right to notify dissatisfaction expires after twenty-four (24) hours from the time the Service Provider has confirmed the service as completed.
- A Customer may rate a Service Provider for their performance using a star rating on the Platform.
- Taskify shall not be held responsible or accountable in any way for any legal, financial or any other damage or harm caused to the Customer by any acts or errors of a Service Provider, including the quality of service performance.
- The Customer shall indemnify and not hold Taskify responsible or accountable in any way for any legal, financial or any other damage or harm caused by any acts or errors of the Customer including breach of agreed purchase agreement terms.
Intellectual Property
The Platform and its original content (excluding any content published by a Platform user), features and functionality are and shall remain the exclusive property of Taskify.
No Taskify intellectual property including trademarks may be used in connection with any product or service or for any other purpose without the prior written consent of Taskify.
Intellectual Property Infringement
Any intellectual property owner, or otherwise authorised on behalf of one, may notify Taskify of any intellectual property infringement on the Platform by giving written notice with a detailed description of the alleged infringement by e-mail to info@taskify.fi and a request for rectification.
Any misrepresentation of intellectual property infringement by such notice shall incur personal liability for any resulting legal, financial or any other damage or harm (including costs and attorneys' fees).
Cancellations and Refunds
- The Service Provider has the responsibility to perform each confirmed service offer as per the purchase agreement terms.
- Any cancellation by a Service Provider or a Customer shall be made using the cancel function on the mobile application or the web application.
- A Service Provider may cancel a confirmed service offer with full refund of the service price to the Customer before the agreed starting time of service.
- A Customer may cancel a service request at any time before a service offer is confirmed by the Customer. No cancellation is possible after the Customer has confirmed the service offer except for a Customer who is a consumer.
- A Customer who is a consumer has a 14-day cancellation period from the time a service offer is confirmed by the Customer. The refund policy for cancellation of a confirmed service offer is set out below:
- full refund of the service price if cancellation is made before the agreed starting time of service;
- 50% refund of the service price if cancellation is made not more than 30 (thirty) minutes after the agreed starting time of service subject to a cancellation fee of €1,9 + 10% applied to the agreed service price inclusive of VAT;
- no refund of the service price if cancellation is made more than 30 minutes after the agreed starting time of service.
- Any refund will be made by using the same payment method the Customer used when paying for the service.
- Taskify may suspend immediately and without prior notice the user account of a Customer or Service Provider for multiple cancellations at the discretion of Taskify. You may request a review of your user account suspension by e-mail to info@taskify.fi
- Taskify shall not be held responsible or accountable in any way for any legal, financial or any other damage or harm resulting from and relating to any cancellations and refunds.
